Instacart is a popular app and website that allows consumers to grocery shop online. Users log into their account, select a store, add items for pickup or delivery, then pay for their basket – all on Instacart’s platform. Today, Instacart boasts millions of users, as well as partnerships with more than 1,800 retailers across 100,000 locations.

In December 2025, Consumer Reports and Groundwork Collaborative released a troubling finding: Instacart was charging different customers different prices for the same products at the same store, at the same time. Instacart called these "price tests" and admitted to running them with at least ten retailers. Although Instacart refused to name those retailers, investigators found evidence of unfair pricing at Costco, Target, Kroger, Safeway, Albertsons, Sprouts Farmers Market, and Wegman's.

These pricing practices may be illegal under consumer protection and antitrust laws. How do your fees work?
