NBA Media Ventures, LLC and NBA Properties, Inc. (together, the “NBA”) operate the NBA mobile app (the “NBA App”), where fans can watch a wide range of NBA-related video content. Users are also able to subscribe to NBA League Pass for expanded access to games and other exclusive programming.
What many users do not realize is that when they watch videos on the NBA App, the NBA may collect and track their personal information—such as email addresses, digital identifiers, and details about what videos they watch—and share that information with third-party advertisers and analytics companies. This data sharing through application programing interfaces (“APIs”) and similar software tools allegedly occurs through behind-the-scenes and may happen without users’ knowledge or consent, potentially violating state and federal privacy laws.
