With mass arbitrations becoming increasingly large and complex, sometimes involving over 100,00 individuals, this article gives an in depth look into the current methods used to organize, administer, and resolve mass arbitrations and posits implementing bankruptcy courts’ framework of estimation proceedings into mass arbitration rules and procedures to efficiently resolve large numbers of claims. The authors propose that adopting an estimation proceeding could prove an effective party-driven alternative to the existing mass arbitration system.
