There is growing evidence that online sports betting platforms, such as FanDuel Sportsbook, are associated with higher rates of problem gambling and addiction than traditional gambling venues, and that these risks are especially acute for young users—including both underage users who are not legally permitted to gamble and young adults whose brains are still developing through their mid-20s—who may gain access to mobile betting apps through inadequate age-verification screening, shared devices, or borrowed identities.

These claims assert that FanDuel Inc., the operator of FanDuel Sportsbook:
- Intentionally designed its platform and mobile apps to be addictive through features including live in-game microbetting, variable-ratio reinforcement schedules, personalized push notifications, bonus incentives, and algorithmic targeting, even while it was aware of addiction risks;
- Failed to implement adequate age-verification and account controls to prevent users under the age of 18 from creating accounts, placing bets, or otherwise accessing the platform, despite regulatory requirements;
- Failed to implement controls to identify or protect vulnerable young adult users who began betting before turning 25;
- Engaged in marketing and promotional practices—including “risk-free” bet offers, daily fantasy sports products, and social-media advertising—that foreseeably reached and attracted underage users; and
- Failed to implement safeguards, such as those voluntarily adopted in other countries, to detect and prevent underage access despite possessing data capable of identifying such use.
Across multiple lawsuits and claims nationwide, plaintiffs are asserting that FanDuel Sportsbook constitutes an unsafe product due to its addictive design and inadequate age-verification safeguards, which allowed underage users to gamble and exposed young adult users to addiction risks, leading to addiction, psychological and physical harm, academic decline, financial losses, and other damages.
